A Federal Capital Territory High Court presided by Justice Olukayode Adeniyi has scheduled January 8 for the verdict in the fundamental rights case brought by the suspended governor of the Central Bank of Nigeria (CBN), Godwin Emefiele.
This decision followed arguments presented by all parties involved in the suit marked FCT/HC/CV/040/2023.Emefiele sought to enforce his fundamental rights to life, personal liberty, a fair hearing, and freedom of movement.
He contested his detention by the Federal Government, the Attorney-General of the Federation, the chairman of the Economic and Financial Crimes Commission (EFCC), and the commission itself. He claimed his prolonged detention since June 10, 2023, without being arraigned, violated his rights as guaranteed by the Nigerian Constitution and the African Charter on Human and Peoples’ Rights.
In his plea, Emefiele requested the court to declare his detention and transfer without arraignment as unlawful. He also sought an injunction against further arrests or detentions without criminal charges being brought against him, alongside seeking N1 billion in damages for the violation of his fundamental rights.
